Terms of Use

Convass connects property owners and seekers directly so they can rent and sell without realtor commissions. These Terms describe the rules of using the platform and the legal relationship between you and us. Please read them carefully — using Convass means you accept them.

Convass is a Canadian service operated from Ontario. Wherever you are reading from, these Terms are written in plain language; the sections below cover what we do, what you agree to do, and what happens if things go wrong.

01. Acceptance of these Terms

These Terms of Use ("Terms") form a binding agreement between you and Convass ("Convass", "we", "us"). By creating an account, posting a listing, contacting another user, or otherwise using convass.com and any related apps or APIs (collectively the "Service"), you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service. We may decline to provide service to anyone for any lawful reason.

02. Eligibility

To use the Service you must be at least 18 years old, have the legal capacity to enter into contracts in Canada, and not be barred from using the Service under applicable law or a prior Convass enforcement action. Listings must relate to real property located in Canada unless we expressly say otherwise.

03. What Convass is — and isn't

Convass is a self-serve marketplace that lets property owners and seekers connect directly. We provide listing hosting, search and discovery, messaging, scheduling, analytics, and informational tools (e.g. mortgage and affordability calculators, walk and transit scores, school ratings, neighbourhood statistics, valuation estimates).

Convass is not:

  • a real-estate brokerage, agent, sales representative, or trade-in-services entity regulated under REBBA / TRESA or any provincial equivalent;
  • a legal, tax, financial, mortgage, appraisal, or inspection professional;
  • a party to any transaction between users;
  • a guarantor of any user's identity, accuracy, or conduct.

Information on the Service is provided for general information only and is not a substitute for advice from a licensed professional. You alone are responsible for the decisions you make based on what you read here.

04. Your account

You agree to:

  • provide accurate, current, and complete information when registering and keep it updated;
  • use a strong, unique password and keep it confidential;
  • enable email verification and any additional security features we offer;
  • notify us immediately at [email protected] if you suspect unauthorized access;
  • not share your account or impersonate another person.

You are responsible for all activity that occurs under your account. We may suspend or disable accounts at our discretion if we reasonably believe these Terms have been violated.

05. Listings and content rules

You are solely responsible for the accuracy, legality, and completeness of every listing and message you publish. When you post a listing you represent and warrant that:

  • you are the owner, an authorized agent of the owner, or otherwise have the legal right to offer the property for rent or sale;
  • the price, square footage, photos, and amenities accurately reflect the property;
  • the property complies with all applicable zoning, occupancy, building, fire, and short-term-rental rules in its municipality;
  • you will keep the listing's status current (active, under contract, leased, sold, withdrawn) and will not relist obviously stale data to manipulate search ranking;
  • no photo, floor plan, or document infringes a third party's copyright, trademark, or privacy.

You grant Convass a worldwide, royalty-free, non-exclusive, sub-licensable licence to host, reproduce, format, and display the content you submit, solely to operate, promote, and improve the Service. You may revoke this licence by deleting the content, subject to a reasonable time for caches and backups to expire.

06. Prohibited conduct

You may not, and may not assist anyone else to:

  • Discriminate. Refuse, restrict, or impose conditions on any rental or sale on grounds protected under the Canadian Human Rights Act, the Ontario Human Rights Code, or the equivalent in your province (race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, age, marital status, family status, disability, receipt of public assistance, etc.). Discriminatory listing language will be removed and may result in account suspension.
  • commit fraud, post fake or duplicate listings, manipulate prices, or otherwise mislead users;
  • harass, threaten, defame, dox, or stalk any other user;
  • collect bulk personal information, scrape the Service, or circumvent rate limits, robots.txt directives, or technical protections;
  • introduce malware, attempt to interfere with the Service's integrity, or access accounts or data that are not yours;
  • use the Service for any unlawful purpose, including money laundering, sanctions evasion, or violating the Real Estate and Business Brokers Act / TRESA when not appropriately licensed;
  • solicit users for off-platform brokerage services without disclosure;
  • misrepresent yourself or your relationship to a property.

07. Moderation, suspensions, and removals

We do not pre-screen user content but we may, at our discretion, review, edit, remove, hide, or refuse to publish any content that we reasonably believe violates these Terms, applicable law, or our community guidelines. We may also suspend or terminate accounts, revoke verification, or restrict features without notice in cases of fraud, safety risk, or repeat violations.

If your content is removed, you will see a moderation note where possible. If you believe a removal was made in error you can appeal by writing to [email protected].

08. Fees

Basic listing, browsing, messaging, and saved-search features are currently free. We may introduce optional paid features (e.g. premium placement, identity verification, professional photo packages); all charges will be disclosed in-flow before you pay. Convass does not charge a commission on any rental or sale between users.

Taxes (HST/GST) apply where required by Canadian law and will be shown at checkout. Paid features are billed in Canadian dollars unless otherwise stated.

09. Informational tools and data sources

The Service surfaces data from third-party and public sources to help you make decisions. These include but are not limited to:

  • school directories from TDSB, TCDSB, and equivalent boards;
  • school performance ratings adapted from Fraser Institute rankings and EQAO assessment results;
  • walk, transit, and bike scores derived from open data;
  • neighbourhood statistics, demographic data, and permit data from open-data portals;
  • mortgage calculations using publicly posted lender rates and Canadian B-20 stress-test methodology;
  • valuation estimates derived from comparable sold or asked prices in our database.

All such information is for general guidance only, can be out of date, and may contain errors. Do not rely on it as a substitute for professional advice, an appraisal, an inspection, a lender pre-approval, a lawyer's review, or your own due diligence. Convass disclaims liability for decisions made in reliance on these tools.

10. Disputes between users

Convass is not a party to any agreement, lease, or sale between users. If you have a dispute with another user — including disputes about deposits, property condition, occupancy, or contracts — you must resolve it directly with that user or through the appropriate court, tribunal (e.g. Ontario's Landlord and Tenant Board), or mediator. Convass may, but is not obligated to, assist by providing records of in-platform communications in response to lawful requests.

11. Intellectual property

The Service, including its software, design, logos, copy, and databases (other than user-submitted content), is owned by Convass or its licensors and is protected by copyright, trademark, and other Canadian and international laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms.

The Convass name, mark, and logo are trademarks. You may not use them without our prior written permission, except to refer to the Service in accurate, descriptive ways.

To submit a copyright takedown request, email [email protected] with the URL, the work allegedly infringed, your contact information, and a statement under penalty of perjury that you are authorized to act on behalf of the rights holder.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, or compatibility. We do not warrant that:

  • the Service will meet your specific requirements;
  • information posted by users (including listings, prices, photos, and amenities) is accurate;
  • any user is who they claim to be;
  • the Service will be free from bugs, errors, or interruptions; or
  • any transaction will be completed.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Convass, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the Service, even if Convass has been advised of the possibility of such damages.

Where liability cannot be excluded under applicable Canadian consumer-protection law, our aggregate liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid Convass for the Service during that period, or (b) CA $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Convass and its affiliates, officers, employees, and agents from any third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) any content you post or message you send; (c) your violation of these Terms or any law; or (d) any dispute with another user.

15. Termination

You may stop using the Service and close your account at any time from your settings page or by writing to [email protected].

We may suspend or terminate your access immediately, with or without notice, for any breach of these Terms, suspected fraudulent activity, or threat to user safety. Sections that by their nature should survive termination (Intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law, and these miscellaneous provisions) will continue to apply.

16. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and Convass each submit to the exclusive jurisdiction of the courts of Ontario for any dispute not subject to binding arbitration or small-claims jurisdiction.

Before filing a claim, you agree to contact us at [email protected] and give us 30 days to resolve the matter informally.

Nothing in these Terms limits your rights as a consumer under the mandatory provisions of the Consumer Protection Act, 2002 (Ontario) or comparable legislation in your province of residence.

17. Changes and miscellaneous

We may update these Terms from time to time. Material changes will be announced at least 14 days in advance by email to verified addresses and by a banner on the Service. Continued use after the effective date constitutes acceptance of the updated Terms.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor in the ordinary course. These Terms, together with the Privacy Policy, are the entire agreement between you and Convass relating to the Service and supersede prior agreements.
